The New BadgerCare Basic Program Began July 1, 2010

Providers should be aware that they may collect payment for the non-covered service from the member if the member accepts responsibility for payment and makes payment arrangements with the provider.

Providers are strongly encouraged to obtain a written statement in advance documenting that the member has accepted responsibility for payment of the service. 

Several Provider Updates have been issued related to covered/non-covered services and are available on the ForwardHealth Portal.

WMS Wins Key Supreme Court Case: Protects Injured Patients and Families Compensation Fund

The Wisconsin Supreme Court issued the long-awaited decision in the Wisconsin Medical Society's lawsuit this morning. In a 5-2 decision, the Court determined that the raid of the Injured Patients and Families Compensation Fund (IPFCF) was unconstitutional. The Court made the following conclusions:

1) Health care providers have a constitutionally protected property interest in the Fund.
2) Health care providers have a right to the security and integrity of the Fund and a right to realize the Fund's investment earnings to moderate, perhaps even lower, their assessments.
3) Health care providers have rights to have excess judgments paid to the proper claimants.
4) The taking of money from the Fund was an unconstitutional taking without just compensation.

"We are extremely gratified with today's Supreme Court ruling because it is a great victory for patients, their families and health care professionals across Wisconsin," said Society President Thomas Luetzow, MD, in this news release. "This ruling sends an important message that the Fund is not a piggy bank. The raid was wrong, and justice has been served."

The Court remanded the case to the trial court for the entry of an order requiring the state to replace the money taken from the Fund, together with lost earnings and interest. The Court also issued a permanent injunction prohibiting the state from transferring money out of the Fund.
